Shared custody of one child- 50-50

Recommended Posts

Hello,

I am helping a friend out with her return and this is the situation. In 2018 her and her husband divorced and they have one child, and it was decided that she (the daughter) would live in a shared custody arrangement. She spends a week with one parent, then a week with the other etc, and there is an arrangement in the divorce agreement that expenses outside of this are shared as well.

My question is about how to claim this in the software. It seems to be an all-or-nothing affair on the Controls page, other than the line about including the child in the CCB calculation. Is there a way to split the claim for this child within this program?

Thank you

Hello dfsampson,

Sharing child care expenses - Quebec resident

For Quebec residents, the program will grant credit by default to the person with the highest income. However, you can change the treatment granted for child care expenses in Quebec.

To do so, in the file of the person who wishes to claim Schedule C, please follow the steps below:

1. In the "Left side menu on the Interview tab", select "Quebec credits".

2. On the right-hand side of the screen, choose "Sharing tax credits between spouses on Quebec Schedules B, C, J and P".

3. On the page entitled "Sharing of the Quebec credit between spouses", select the line "Québec - Schedule C - Child care" and in the drop-down menu to your right, indicate your choice.

4. If you choose "Claim All", the total amount of the Schedule C credit will be given to the person requesting it.

5. However, if you choose "Claim portion", on the line that follows, it will indicate "If you selected Claim portion, enter the amount you are claiming", in this field we need to enter the amount the taxpayer wishes to claim. The unclaimed portion will be automatically entered in the spouse`s return.

The program will carry over the amount to line 455 of the Quebec return and generate Quebec Schedule C in the designated person's file.
